General contract terms for guided tours by commercially authorized tourist guides.
- These contractual conditions are valid if this has been agreed in detail between the contracting parties.
- If no separate or deviating regulation has been agreed, a customary local tour at a customary local fee is deemed to have been agreed. The customary local fee for Austrian tourist guides in Austria is the fee that is usually charged, which the Association of Certified Tourist Guides publishes annually in the course of its survey of its members. - Travel supervisor activities of a tourist guide (§126 ABS4 GewO), in particular transfers, are to be treated as guided tours.
- The client is requested to invoice his customer separately for the work contract fee for the services of the tourist guide (guide fee) and any booking fee for the mediation of the service of the tourist guide.
- Cancellation: The client does not have to pay the tour guide a cancellation fee if the cancellation is received in writing by the tour guide no later than 14 days before the tour date, or if a different cancellation agreement has been expressly agreed in writing. If the client cancels between 14 and 3 days before the date, half of the agreed tour fee must be paid as a cancellation fee. If the client cancels less than 3 days before the agreed tour date, the full agreed fee must be paid. The day of cancellation and the day of operation count towards the deadline calculation. The full agreed fee must also be paid as a cancellation fee if the customer does not appear at the agreed meeting point during the waiting time. All of the above cancellation fees are lump sums that are to be paid regardless of fault or damage that has occurred. The cancellation fee must be paid separately for each canceled tour.
- Waiting period. If the client is late, the guide is obliged to wait 45 minutes for the client at the agreed meeting point. The waiting time is included in the duration of the tour and thus reduces its scope. In turn, the client is obliged to wait 15 minutes for the guide. This waiting time is not included in the scope of the tour.
- Impediment: In the event of an unavoidable impediment, the tourist guide undertakes to provide a professionally equivalent, authorized substitute. The client must be informed of this in any case.
- Unless otherwise agreed, payment is made in cash after the service has been rendered.
- The tour guide is prohibited from advising the guests brought by the client to place their orders directly in the future when orders are placed by third parties. If no further program is planned after the end of the tour, he may, however, offer further services after the tour.
- In the event of an epidemic or pandemic, the guidelines as decreed by the Republic of Austria or the relevant federal state always apply.
